PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorari, calling for the records relating to the impugned proceedings issued by the 3rd respondent Additional Assistant Elementary Educational Officer in Na.Ka.No.1650/A4/2015 dated 14.01.2016 and quash the same.

ORDER

This writ petition is filed challenging the impugned order, dated 14.01.2016, wherein the school was directed to reinstate the middle school Headmaster namely, G.Selva Mariappan. The said G.Selva Mariappan was placed under suspension. Finally, the respondents have taken all the facts into consideration directed the school to reinstate the G.Selva Mariappan and revoke the suspension order. Aggrieved over the same, the writ petition is filed by the school management.

2. Today, when the matter was taken up for hearing, the learned Government Advocate appearing for the official respondents submitted that the official respondents have passed another order, dated 13.01.2016, bringing the school under direct payment. The said order was also challenged. Subsequently, pending writ petition, the official respondents withdrew the direct payment. Now the G.Selva Mariappan was reinstated back into service. It is further submitted that the said G.Selva Mariappan has received salary for the said suspension period. Therefore, nothing survives for adjudication in this matter.

3. In view of the above observations, this Writ Petition is closed. No Costs. Consequently, connected miscellaneous petition is closed. Index : Yes / No 31.03.2023 Internet : Yes ksa 3/5
