PRAYER :- For Bail in Crime No.1167 of 2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested and remanded to judicial custody on 28.09.2022 for the offences punishable under Sections 420, 468 and 471 IPC in Crime No.1167 of 2022, seeks bail. 2.The case of the prosecution is that the petitioner was found in possession of fake liquor bottles, printed forged lables and forged hologram stickers. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. The petitioner is in judicial custody from 28.09.2022 and hence, he may be released on bail.

4.The learned Additional Public Prosecutor strongly opposed this petition stating that this is the petitioner's second bail application and the earlier application was dismissed by this Court, dated 07.10.2022 in Crl.O.P.(MD)No.17960 of 2022. The petitioner is a habitual offender and he is having fourteen previous cases, which are similar in nature and the investigation is pending. 5.Considering the seriousness and gravity of the offence and also considering the facts that the petitioner is a habitual offender and he is having fourteen previous cases, which are similar in nature and the investigation is pending, this Court is not inclined to grant bail to the petitioner at this stage. 6.Accordingly, this Criminal Original Petition is dismissed.
