Writ Petition is filed under Article 226 of the Constitution of India, praying this Court Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 3rd respondent to sub divide the property more fully described in schedule in the sale deed vide doc No.1179 of 2022 dated 21.07.2022 registered at SRO, Sayalkudi, Ramnad District and issue separate patta based on the petitioner`s representation and the payment challan for subdivision and separate patta dated 18.10.2022, 22.08.2023 and 10.07.2024 within time frame fixed by this Hon'ble court and pass such further or other orders as this Honourable Court may deemed fit and proper in the circumstances of the case and thus render justice. ORDER:- This Writ Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.AnanthC.Rajesh Advocate for the Petitioner and of Mr.K.R.Badurus Zaman , Government Advocate for the respondents,1 to 3 this Court made the following order:
The above Miscellaneous Petition is filed to recall the order passed in W.P.(MD).No.18778 of 2024 dated 07.08.2024.
2. Considering the fact that misrepresentation has been made before this Court and the order has been passed based on such misrepresentation, the above Miscellaneous Petition is allowed and the order passed by this Court in W.P.
