PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, to direct the respondents 1 to 3 and 5 to take action against the respondents 7 and 8 for illegal mining of sand in S.No.479/12, 14 and 15 of Kanakkankudi Village, Thiruppuvanam Taluk, Sivagangai District on the basis of the petitioner's representation dated 20.08.2024.

O R D E R

This writ petition has been filed to direct the respondents 1 to 3 and 5 to take action against the respondents 7 and 8 for illegal mining of sand in S.No. 479/12, 14 and 15 of Kanakkankudi Village, Thiruppuvanam Taluk, Sivagangai District on the basis of the petitioner's representation dated 20.08.2024.

2. Heard both sides. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. It is the case of the petitioner that the respondents 7 and 8 are illegally removing the soil from the above said land without any valid permission. In this regard, she gave a complaint before the official concerned. But, no action has been taken so far. Hence, seeks direction.

4. The learned Government Pleader, on instructions, would submit that the petitioner and the respondents 7 and 5 are co-sharers. The petitioner has also involved in removing the soil, without any permission. He would further submit that in this regard, action will be taken as per law.

5. Recording the above, if there is any violation of Mines and Minerals (Development and Regulation) Act, the official respondents are directed to take action as per law against both the petitioner and the respondents 7 and 8.
