This petition has been listed for extension of time pursuant to the letter sent by the concerned Trial Court.

2. The learned Judicial Magistrate No.II, Virudhunagar by his letter dated 05.02.2026 has sought further time to dispose of the case in C.C.No.128 of 2021 .

This Court had already directed the learned Judicial Magistrate No.II, Virudhunagar to dispose of the case in C.C.No.128 of 2021 within a period of three months from the date of receipt of the order. The learned Judicial Magistrate No.II, Virudhunagar in his letter stated that charges were framed and questioned against Al to A8 on 03.09.2025. Subsequently, the case was posted for trial on 10.09.2025. LWI was examined as PW1 on 19.09.2025. LW2, LW7 and LW8 were examined as PW2 to PW4 on 23.09.2025. LW3 was examined as PW5 on 30.09.2025, and on that day, the chief examination of PW5 was partly completed and the case was then posted for continuation of the chief examination of PW5. Thereafter, the chief examination and cross examination of PW5 were completed in full on 07.10.2025. LW4 was examined as PW6 on 24.10.2025 LW6 was examined as PW7 on 28.10.2025 and LW5 was examined as PW8 on 04.11.2025. Subsequently, LW19 was examined as PW9 on 11.12.2025 and the case was posted for issuance of summon to LW20 hearing on 19.12.2025. Further the learned Assistant Public 2/4

Prosecutor filed a petition u/s.311 r/w 242(2) of Cr.P.C for the production of additional documents and recall of PWI for further chief examination, stating the necessity to produce and mark the additional documents. The aforesaid petition under section 311 r/w 242(2) of Cr.P.C. was numbered as Crl.M.P. No. 1495/2025 on 19.12.2025 and the same was allowed on 19.01.2026. As per order of the aforesaid petition, PWI is examined in full on 23.01.2026. and now the case is posted for issuance of summons to LW9 to LW18 on 10.02.2026. Further in this case there are 20 witnesses, of which 9 witnesses have been examined till date, and 11 witnesses are yet to be examined. Due to the reasons stated above, the case could not be disposed of as directed by this Court.

4. Considering the request made by the learned Judicial Magistrate No.II, Virudhunagar and also considering the facts and circumstances of the case, time already granted by this Court to dispose the case in C.C.No.128 of 2021 is extended by another three months from the date of receipt of a copy of this order.
