PRAYER :- To enlarge the petitioner on bail in the event of his arrest or surrender in C.C.No.16 of 2019 on the file of the learned Judicial Magistrate Court, Uthamapalayam in connection with the Crime no.418 of 2017 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who is facing a case for the offence under Sections 1/3

294(b), 324, 506(2) of IPC and Section 3(1) of the TN Public Property (Prevent of Damage & Loss) Act, 1992, in C.C.No.16 of 2019 on the file of the learned Judicial Magistrate Court, Uthamapalayam, in Crime No.418 of 2017 on the file of the respondent police, seeks bail.

2. The petitioner was absent during the trial in C.C.No.16 of 2019 on the file of the learned Judicial Magistrate Court, Uthamapalayam. Therefore, Non-Bailable Warrant came to be issued on 12.12.2023. Hence, this petition. 3.Heard both sides.

4.It is stated that the petitioner filed a recall application before the trial Court. After being told that the application was allowed, he went away from the Court. Thereafter, the petition was dismissed.

5. Be that as it may, the petitioner has to once again, surrender before the trial court and file application to recall the Non-bailable Warrant and this is not a fit case for grant of anticipatory bail.
