25.07.2025 for inviting application for appointment of trustees quash the same and consequently directing the 2nd respondent to conduct fair election by publishing a proper final voter list after considering the petitioner objection petition dated 06.04.2025 and then calling for application from the members of the trust, to call for objections giving specific time, and thereafter conduct the elections of appointment of trustees for Arulmigu Ammaluammal alias Guruvammal Trust.

ORDER

The writ petition has been filed challenging the order passed by the second respondent bearing Na.Ka.No.9415/2024/A1, dated 25.07.2025. 2.The petitioner appears to be a regular Court march, who keeps approaching this Court on regular basis. On the last three occasions, the petitioner has approached this Court, which has ultimately culminated into an order dated 27.11.2024 in W.P.(MD) No.24382 of 2024, wherein, the petitioner had challenged the election notification issued by the Joint Commissioner, the second 2/6

respondent herein, in his proceedings bearing Ref.No.Ve.Aa.No. 86/Se.Ma.Tho.A./Madurai, dated 27.09.2024 advertised in the newspaper on 28.09.2024.

3.By the aforesaid order dated 27.11.2024, this Court had passed the following order:- "5.In view of the above, I am of the view that the impugned advertisement in the present writ petition is unsustainable and hereby the same is set aside, subject to the following directions: (i) The second respondent shall publish a list of eligible voters within a period of four weeks from the date of receipt of this order, after giving a two-weeks period for receiving objections, if any. (ii) Upon receiving objections, if any, the second respondent shall finalize and publish the final list within further period of two weeks therefrom.

(iii) Simultaneously, the second respondent shall call for nominations from eligible persons, fixing an election date within a period of four weeks thereafter.

6.With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed."

4.Pursuant to the aforesaid order of the Writ Court in W.P.(MD) No.24382 of 2024, the impugned Notification has been issued, which has now been challenged.

5.According to the petitioner, despite a categorical direction of the Court for holding election, the respondents are proposing to appoint persons contrary to the directions of the Court. The petitioner is also questioning the electoral list prepared by the second respondent.

6.Since the electoral list has already been prepared by the second respondent, there can be only further direction to the second respondent to conduct the election as was ordered by the Writ Court vide order dated 27.11.2024 in W.P.(MD) No.24382 of 2024, within a period of 8 weeks from the date of receipt of a copy of this order. In case, the petitioner is aggrieved by the election results, it is open for the petitioner to workout the remedy in the manner known to law.

7.With the aforesaid direction and liberty, the Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed. Index : Yes / No 26.08.2025 Internet : Yes / No 4/6
