ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 294(b) and 307 IPC in Crime No.369 of 2022 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the de-facto complainant while trying to drop garbage adjacent to the petitioner's land, the petitioner herein had driven the vehicle as against the de-facto complainant and caused injury to him. Hence, the complaint. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.18563 of 2022 3.The learned counsel for the petitioner would submit that due to money dispute, a false case was foisted against the petitioner. He would further submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. Hence, he prays for anticipatory bail.
4.The learned Government Advocate (Crl.Side) strongly opposed this petition stating that the injured is still taking treatment in the hospital.
5.Considering the gravity and nature of the offence and also considering the fact that the de-facto complainant is still in hospital, this Court is not inclined to grant anticipatory bail to the petitioner.
