PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, calling for the records relating to the impugned Staff Fixation issued by the third respondent Chief Educational Officer for the academic year 2022-2023 in the petitioner school vide proceedings in Mu.Moo.No.9256/Aa1/2022, dated 09.01.2023, in so far as it excludes counting of student in entire English Medium sections in High School level for assessing staff strength under grant-in-aid scheme and thereby renders 10 teaching posts viz., 1 B.T.Assistant (Tamil) 3 B.T Assistant (Maths), 1 B.T Assistant (Science) 4 Secondary Grade Teacher and 1 Physical Education Teacher as surplus and the consequential order of deployment in Na.Ka.No.000835/A4/2023, dated 09.06.2023 deploying Mr.M.Robert Bellarmin, BT Assistant (Maths) to another school, quash the same.

The instant Writ Petition has been filed by an Aided Minority Institution, challenging the general instructions issued by the Chief Educational Officer, Kanyakumari, on 09.01.2023 followed by a consequential deployment order, dated 09.06.2023. 2/5
2. Under the consequential impugned order, one M.Robert Bellarmin, B.T Assistant (Maths) was transferred from the petitioner school viz., St.Xavier Higher Secondary School, Pattarivilai.
3. On instructions, the learned Additional Government Pleader appearing for the respondents submits that the order of deployment has been recalled by the Chief Educational Officer, Kanyakumari and the teacher has been retained in the parent school itself.
4. Recording the same, this Writ Petition stands closed. There shall be no order as to costs. Consequently connected Miscellaneous Petitions are closed.
