Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 1st respondent to transfer the investigation from the second respondent and to appoint some other investigation officer for conducting proper enquiry in the case in Cr.No. 80 of 2025, U/s.194 of BNS on the file of 2nd respondent police, for filing the final report by considering the petitioner's representation, dated 17.07.2025, as per the law, within the time stipulated by this Court. 1/7

The petitioner, who is working as a Coolie in a Prawn Farm has lodged a complaint that this petitioner's son was found dead in suspicious circumstances in a Well, situated in the Prawn Farm. On the complaint of the petitioner's husband, a case in Crime No.80 of 2025 has been lodged under Section 194 of BNSS. Apprehending that the respondent police has not conducted the investigation in a proper manner, the petitioner has approached this Court seeking transfer of investigation from the file of the second respondent police. 2.The learned counsel for the petitioner submits that the petitioner is having a doubt that his son's friends have committed murder. According to the learned counsel, the deceased was last seen on 29.06.2025, along with his friends, namely, Selvaprakash, Selvamanikandan. On the next day, his body was found in the Well. The petitioner claims that there were blood injuries on the face of the deceased. She has made some efforts to find out the cause of the death of 2/7
her son. One Narayanan, who is working in the same Farm claims that he knows something about the cause of the death, however he has refused to divulge the same. The petitioner, on her own efforts, has also collected the CCTV footage that the deceased went along with three other persons in a Scooty in the previous day of occurrence. She has also furnished the same to the respondent police. However, the respondent police has not conducted the investigation in a proper manner and therefore, the petitioner is before this Court.
3.Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Crl.side), who takes notice for the first respondent submits that the petitioner has suffered with epilepsy. He was found dead in suspicious circumstances on 30.06.2025. His body was recovered from a Well and postmortem was also conducted in Government Hospital, Keelakkarai. The doctor, who conducted the postmortem has reserved his opinion for want of viscera that there is no external injury found in the body. A copy of the postmortem certificate is placed before this Court. He further submits that the Viscera report is awaited and depending upon the Viscera, they would conduct the investigation further. The learned Government Advocate further submits that they have also enquired about 3/7
the three other persons, who were said to have travelled along with the deceased in a Scooty. According to the police, the deceased has not travelled along with them on 29.06.2025.
4.This Court considered the rival submissions made and also perused the materials placed on record.
5.The petitioner is working as a coolie and her son aged about 25 years was found dead in suspicious circumstances. The investigation agency has conducted the postmortem and they are awaiting for the viscera report. From the Postmortem certificate produced by the respondent police, it is seen that no external injury present in the body of the deceased, however, the petitioner claims that there were some injuries found in the body of the deceased.
6. Since the respondent police claims that the investigation is being conducted in a proper manner and they are awaiting to receive the Viscera report to proceed further, this Criminal Original Petition is closed for the present, with the following directions: 4/7
i. The Investigation Agency is directed to furnish a copy of the postmortem report as well as the Viscera report to the petitioner, enabling her to verify with any of the doctors of their choice. ii. The respondent police is expected to conduct the investigation in a fair and proper manner in Crime No.80 of 2025. iii.The Deputy Superintendent Police, Ramanathapuram shall monitor the investigation.
iv. A copy of the final report shall also be furnished to the petitioner. The petitioner shall verify the same with the friends of her son and if she found any other materials, she can file a fresh application.
