ORDER

The Criminal Original Petition has been filed, invoking Section 528 B.N.S.S., seeking orders, to direct the learned II Additional District Judge cum PCR Court, Tirunelveli to consider the bail application of the petitioner on the same day of surrender in Crime No.142 of 2024 on the file of the second respondent police.

2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the State would submit that the petitioner and the other accused waylaid the defacto complainant and attacked with Aruval. He would further submit that the other accused/A1, A3 and A5 were already arrested and are in judicial custody.

3. Considering the nature of the charges levelled against the petitioner and also the fact that the co-accused are in judicial custody, this Court is not inclined to entertain this petition at this point of time.
