Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order passed by the 2nd respondent in Na.Ka.P1/203/2025 dated 11.06.2025, and quash the same as unconstitutional and consequently forbearing the 2nd respondent from 1/6

ORDER

This writ petition has been filed challenging the order passed by the 2nd respondent in Na.Ka.P1/203/2025 dated 11.06.2025 and also to forbear the 2nd respondent from preventing the petitioner from working as Data Entry Operator in the 3rd respondent panchayat as per the agreement dated 01.04.2025.

2. Considering the nature of the order proposed to be passed in this writ petition, notice to the third respondent is dispensed with and this writ petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioner is that the petitioner joined as Data Entry Operator in the third respondent Panchayat on 03.04.2025 on 2/6

contract basis, as per the agreement between the petitioner and the second respondent dated 01.04.2025 and the petitioner had been working till 16.04.2025. While this being so, the second respondent stated that one political party threatened him not to allow the petitioner to work. Pursuant to the same, the petitioner was not allowed to work. The petitioner filed a writ petition before this Court in WP(MD)No.13448 of 2025, which was also disposed by directing her representation to be considered after affording an opportunity to the petitioner. However, the impugned order came to be filed stating that one Ramkumar is continuing the as Data Entry Operator and that there is no vacancy in the third respondent panchayat. Challenging the same, this writ petition came to be filed.

The learned counsel appearing for the petitioner submits that the second respondent has already entered an agreement with the petitioner appointing her as Data Entry Operator on contract basis from 01.01.2025 to 31.12.2025. However, she was not allowed to work, which is in violation of the agreement entered into between the petitioner and the second respondent.

5. The learned Special Government Pleader appearing for the respondents 1 and 2 would submit that the writ petition itself is not maintainable. When the petitioner was appointed on contract basis and she was not permitted to continue her work, she can seek her remedy before the competent civil Court in the manner known to law. However, without availing the same, the petitioner has approached this Court.

6. In the present case, the third respondent Panchayat appointed one Ramkumar as Data Entry Operator. If at all the petitioner is aggrieved by the same, she can challenge the said appointment by impleading himself as a party. However, without challenging his appointment, filing of this petition is unsustainable one. In view of the same, this writ petition is dismissed with liberty to the petitioner to work out her remedy before the competent forum. No costs.
