PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 4 to cancel the patta No.116, issued in favour of sixth respondent in connection with property comprised in S.No.235/1B1 to an extent of 0.5.70 hectares situated at Paiyur Pillaivayal Village, Sivagangai Taluk, , Sivagangai District and restore the same in connection with Patta No.476, on the basis of the Petitioner's representation, dated 3.6.2025 within the time stipulated by this Court.

O R D E R

The Writ Petition is filed seeking a direction to the respondents 1 to 4 to cancel the patta No.116, issued in favour of sixth respondent in connection with the property comprised in S.No.235/1B1 with an extent of 0.5.70 hectares situated at Paiyur Pillaivayal Village, Sivagangai Taluk, Sivagangai District and restore the patta in the name of Petitioner, by considering the Petitioner's representation, dated 3.6.2025.

2.Mr.D.S.Nedunchezian, learned Government Advocate takes notice for the respondents 1 to 4. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.According to the Petitioner, the subject property was originally owned by the Petitioner's father and patta for the same was issued in his name in Patta No.476. Taking advantage of the Petitioner's absence in the subject village, the private respondents 5 and 6 obtained patta in the name of sixth respondent in Patta No.

116. Therefore, the Petitioner submitted a representation before the respondents 1 to 4 on 3.6.2025 seeking cancellation of patta issued in the name of sixth respondent and restoration of patta in the name of Petitioner's late Father Muthusamy. The said representation has not been considered so far. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra.

4.Mr.D.S.Nedunchezian, learned Government Advocate appearing for the respondents 1 to 4 would submit that the representation submitted by the Petitioner will be considered on its own merits, within the time stipulated by this Court. 5.In view of the same, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the representation submitted by the Petitioner on 3.6.2025 and pass final orders on its own merits after issuing notice to the Petitioner, private respondents 5 and 6 within a period of 12 3/6

weeks from the date of a copy of this order.

6.With the above directions, the Writ Petition stands disposed of. No costs.
