PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents 1 to 4 to remove encroachment made in S.No.1226 and S.No.1227 in Vembur Village, Kujiliyambarai Taluk, Dindigul District, by considering the petitioner's representation dated 22.12.2023 within a period stipulated by this Court. O R D E R

[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted seeking a direction to the respondents 1 to 4 to remove the encroachment made in Survey Nos.1226 and S.No.1227 in Vembur Village, Kujiliyambarai Taluk, Dindigul District, by considering the petitioner's representation dated 22.12.2023, within a period stipulated by this Court.

2. Today, when the matter is taken up for hearing, learned Additional Government Pleader appearing for the respondents 1 to 4, on

instructions, submitted that a survey has been conducted and encroachments have also been identified by the authorities concerned and consequently, notice, under Section 7 of the Tamil Nadu Land Encroachment Act, 1905, has also been issued to the encroachers. By affording an opportunity to the encroachers, final decision will be taken under the provisions of the said Act.

3. In view of the said submission, the respondents 2 & 3 are directed to complete the enforcement action and remove the encroachments, if any, identified, in the manner known to law, within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above observation, this writ petition stands disposed of. No costs.
