ORDER

The writ petition is filed seeking a mandamus directing the first respondent to register the release deed dated 20.06.2025, uploaded on the web portal of the Tamil Nadu Registration Department, executed by the 6th and 8th petitioners in favour of the 1st petitioner, and presented to the first respondent on 20.06.2025

pursuant to the token dated 20.06.2025, fixing the time for registration between 12:00 and 13:00 hours.

2. On perusal of the affidavit filed in support of the writ petition, it is seen that although an appointment was duly taken and a time slot was fixed, the document was not received by the first respondent / Sub-Registrar.

3. When the matter came up for hearing, the learned Additional Government Pleader, taking notice on behalf of the first respondent, submitted that the document was not received and could not be registered solely on account of objections raised by certain third parties.

4. I have considered the rival submissions and perused the material records of the case.

5. The course of action adopted by the first respondent / Sub-Registrar cannot be countenanced. When the petitioners duly present a release deed, it must be received by the first respondent / Sub-Registrar. Any objections, if raised, must be addressed through due enquiry and an order be passed in accordance with law.

Accordingly, this writ petition is disposed of on the following terms: (i) The petitioner shall appear before the first respondent / SubRegistrar on 02.04.2026 and present the said document at about 10:30 a.m. (ii) The document shall be received by the first respondent / SubRegistrar and processed in the manner known to law. (iii) If there is no impediment, the document shall be registered. (iv) If any objection is raised, an enquiry shall be conducted in accordance with law, and an appropriate order shall be passed expeditiously. No costs.
