ORDER

(Order of the Court was made by G.K.ILANTHIRAIYAN,J.) This appeal has been preferred as against the award passed in M.C.O.P.No.984 of 2016 on the file of learned Motor Accident Claim Tribunal / Special Sub Court, Tirunelveli.

2. This Court while admitting the Civil Miscellaneous appeal granted interim stay on 27.11.2023 with a condition that the appellant shall deposit 50% of the award amount with proportionate accrued interest and costs to the credit of CMA(MD) No.1196 of 2023 before the Indian Bank, High Court Branch, Madurai within a period of six weeks from the date of receipt of a copy of the order and thereafter the CMA 2/3

itself was dismissed by an order dated 30.04.2025. Now the claimants have filed this petition seeking permission to withdraw the said amount.

3. In view of the same this petition is allowed and the Registry is directed to transfer the amount which was deposited by the appellant to the credit of CMA(MD) No.1196 of 2023 before the Indian Bank, High Court Branch, Madurai to the file of the M.C.O.P.No.984 of 2016 on the file of learned Motor Accident Claim Tribunal / Special Sub Court, Tirunelveli forthwith with acrued interest and costs if any. Thereafter the claimants are permitted to withdraw the same by filing appropriate application inaccordance with law.
