The petitioner with a grievance that the application filed by 1/4

him, under section 175(3) of BNSS, in the month of January-2025 has not been concluded by the learned Judicial Magistrate, Peraiyur, has approached this Court.

2.The learned counsel for the petitioner submits that the petitioner has filed above application in the month of January 2025 and that has been periodically adjourned by the learned Judicial Magistrate, without passing any orders.

3.Mr.P.Kottaichamy, learned Government Advocate (Crl. Side), who takes notice for the fifth respondent submits that this petitioner has already lodged a complaint before the respondent police and the same was enquired and it was closed .Thereafter, this petitioner has preferred the above complaint before the Judicial Magistrate, Periyur, under Section 175(3) of BNSS, 2023.

4.This Court considered the rival submissions made and also perused the materials placed on record.

5.It is not proper on the part of the Judicial Magistrate, Peraiyur, in not disposing of an application filed under section 175(3) of BNSS, for over a period of eight months. Therefore, petition is disposed of with a direction to the learned Judicial Magistrate, Peraiyur, to take a call on the merits of the complaint of the petitioner and decide the same, within a period of four weeks from the date of receipt of a copy of this order.
