RESPONDENTS/COMPLAINANTS Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition Para 6(b) imposed on the Petitioner in Crl.O.P. (MD) No.19032/2021 dated 02.12.2021 by expunging the condition in so far as to appear before the Respondent.
Order :This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.BALAJI.A, Advocate for the petitioner and of Mr.M.VAIKKAM KARUNANITHI, GOVT. ADVOCATE (CRIMINAL SIDE) on behalf of the Respondent the court made the following order:- This petition is filed seeking modification of the condition 6 (c) imposed upon the petitioner, in Crl.OP(MD)No.19032 of 2021, dated 02.12.2021.
2.The petitioner was released on anticipatory bail, by this Court, on 02.12.2021 with certain conditions and one of the condition is that the petitioner should appear before the respondent police daily at 10.30. am for a period of one month and thereafter, as and when required for interrogation.
3.The learned counsel for the petitioner would submit that the petitioner was directed to appear before the respondent police, East Police Station, Sivakasi, at 10.30 a.m, by the order of this Court, in Crl.OP(MD)No.13474 of 2021, dated 11.12.2021. Now, in the above said Crl.OP(MD)No.19032 of 2021, dated 02.12.2021, he was directed to appear before the respondent police, Sivakasi Town Police Station, Virudhunagar District, at 10.30 a.m. He has already been appearing before the respondent police, East Police Station, Sivakasi. Since in both the matters, he has been directed to appear https://hcservices.ecourts.gov.in/hcservices/
before the respondent police at 10.30 a.m, he is not in a position to travel from one police station to another police station. 4.Considering the above said submission made by the learned counsel for the petitioner, the condition 6(c) imposed upon the petitioner in Crl.OP(MD)No.19032 of 2021, dated 02.12.2021, is modified to the effect that the petitioner shall report before the respondent police, Sivakasi Town Police Station, Virudhunagar District, daily at 09.30 a.m and time is extended for a period of 2 weeks for furnishing sureties. In respect of other conditions shall remain unaltered.
