PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to survey and to earmark the four boundaries of the petitioner properties in S.Nos.332/14 and 332/15 at Sankaralingapuram Village, Vilathikulam Taluk, Thoothukudi District, on the basis of the petitioner's representation dated 13.09.2019. ORDER

This writ petition is filed to direct the respondents to survey and to earmark the four boundaries of the petitioner's property in S.Nos.332/14 and 332/15 situated at Sankaralingapuram Village, Vilathikulam Taluk, Thoothukudi District.

2.According to the petitioner, he made a representation dated 13.09.2019 to the 1st respondent to survey and to earmark the four boundaries for the property in S.Nos.332/14 and 332/15 situated at Sankaralingapuram Village, Vilathikulam Taluk, Thoothukudi District. But, so far no action has been taken by the aforesaid Tahsildar. Hence, the present writ petition.

3.The learned Additional Government Pleader appearing for the respondents would submit that the representation of the petitioner's father for the same relief as stated in the representation of the petitioner dated 13.09.2019 had been considered and appropriate orders have already been passed by the authorities concerned. As against the same, the petitioner's father filed an appeal before the appellate authority and the same had also been disposed of. Therefore, a similar relief made by the petitioner by way of filing this writ petition ought not to be entertained. https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.22528 of 2019 4.Further, the learned Additional Government Pleader would submit that if the Court directs the 1st respondent to consider the petitioner's representation dated 13.09.2019, the same shall be considered on merits and in accordance with law, within a time frame to be fixed by this Court.

5.In view of the submission made by the learned Additional Government Pleader, this Court is inclined to pass the following direction:- The 1st respondent is directed to consider the representation of the petitioner dated 13.09.2019 and pass appropriate orders on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.

6.With the above direction, this Writ Petition is disposed of. No costs.
