Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the second and third respondents to measure the petitioner's land in survey No.605/16B and 17B, Patta No. 1703, measuring 437 sq. feet, situated at Ulagupitchanpatti Village, Thiruvathavur panchayat, Melur Taluk, Madurai District within a time fixed by this Court and further, directing the fourth respondent to provide adequate police protection to the revenue officials at the time of measurement so as to prevent interference by respondents 5 to 8 and to ensure immediate and effective protection for the purpose of measurement and mutation.

O R D E R

After submitting an application seeking a survey, the present Writ Petition has been filed because such application was not acted on.

2. Learned counsel for the petitioner relies on sale deed dated 13.09.2013 and patta No.1703 as evidence of the petitioner's title and rights in relation to the relevant property. In spite of submitting an 2/5

application in January 2024, he submits that no action has been taken.

3. Learned Government Advocate accepts notice on behalf of respondents 1 to 3 and learned Government Advocate (Crl.Side) accepts notice on behalf of fourth respondent. On instructions, learned Government Advocate submits that the survey would be conducted after issuing notice to the petitioner and the private respondents herein.

4. In view of the above submission by learned Government Advocate, notice to the private respondents is dispensed with in this Writ Petition.

5. Accordingly, without making any observation on the merits, this Writ Petition is disposed of by directing the second and third respondents to consider and dispose of the petitioner's application within a period of twelve weeks from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner, private respondents and any other owners of neighbouring lands. If necessary, in relation to such survey revenue officials may take the assistance of the police 3/5

authorities.

6. With the above direction, this Writ Petition is disposed of. No costs.
