For Respondent : Mr.R.SURESH KUMAR, Government Advocate (Crl.Side) PRAYER :- Criminal Original Petition has been filed under Section 439(1)(B) of Cr.P.C. to call for the records pertaining to the order passed by the learned Principal District and Sessions Judge, Tiruchirappalli in Crl.MP.No.3942/2023 dt.18/8/2023 and set aside the conditions imposed by the learned Principal District and Sessions Judge, Tiruchirappalli directing the Petitioner to deposit a sum of Rs.8,45,000/- to the credit of the case in crime number and permitted the defacto complainant to withdraw the amount deposited by the Petitioner and consequently relx the same.
ORDER
This petition has been filed to set aside the order passed by the learned Principal District and Sessions Judge,Tiruchirappalli in Crl.MP.No.3942/2023 dt.18/8/2023.

2.By the above said order, the learned Principal District and Sessions Judge, Tiruchirappalli, while granting bail, directed the petitioner to deposit 50% of the cheque amount, i.e., Rs.8,45,000/- to the credit of crime number. The learned counsel for the petitioner would submit that in the above said order it was observed that the petitioner is ready to deposit 50% of the cheque amount. But, no such undertaking was given by the petitioner's counsel. He would further submit that such condition cannot be imposed to the petitioner.
3.Therefore, challenging the above said condition, the petitioner is before this Court. Considering the nature of offence only, the above said condition was imposed upon him by the Sessions Court. However, the petitioner without approaching the Sessions Court for modification, directly came to this Court. I find no reason to entertain this petition. This petition deserves to be dismissed.
