PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents to relieve the petitioner from service on the ground of medical invalidation and to provide compassionate appointment to the petitioner wife namely B.Subath Selva Nayaki by considering the representation dated 21.02.2024, 23.02.2024 and 10.05.2024 in the light of the disability certificate dated 28.02.2024. 1/4

ORDER

The instant writ petitioner has been filed by a Conductor working in the respondent transport corporation, seeking a mandamus to relieve him from service on the ground of medical invalidation and to provide compassionate appointment to his wife.

2.According to the learned Counsel appearing for the writ petitioner, the Medical Board has declared him unfit to be a Conductor and he is now bedridden and not attending duty. Therefore, he has sent several representations to the transport corporation to discharge him from duty on the ground of medical invalidation. The petitioner has also sent a representation on 10.05.2024 requesting the management to discharge him from duty and to provide compassionate appointment to his wife. Since there is no response, the present writ petition has been filed.

3.Considering the above said facts, the respondents are directed to consider the representation of the writ petitioner dated 10.05.2024 and pass 2/4

orders relating to medical invalidation as well as consider the request of the petitioner for providing compassionate appointment to his wife. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

4.With the above said observations, this writ petition stands disposed of. No costs.
