Respondent/ Respondent PRAYER :- This petition is filed under Section 439(i)(b) of Cr.P.C., to call for the records of the impugned order in Crl.M.P.No.3759 of 2023 dated 03.08.2023 passed by the learned Principal Sessions Judge, Kanyakumari District at Nagercoil and set aside the same and relax the condition.

ORDER

This Criminal Original Petition has been filed by the petitioner seeking modification of the conditional order, dated 03.08.2023 passed in Crl.M.P.No.3759 of 2023 by the learned Principal Sessions Judge, Kanyakumari District at Nagercoil.

2. Learned counsel for the petitioner submitted that the petitioners was ordered to comply the conditions that first petitioner / accused shall appear and sign before the Sub Inspector of Police, Puthukadai Police Station daily twice at 10.00AM and 5.00 PM until further orders. And the second petitioner / accused shall appear and sign before the Sub Inspector of Police, Arumanai Police Station daily twice at 10.00AM and 5.00 PM until further orders and the third petitioner shall appear and sign before the Sub Inspector of Police, Nithiravilai Police Station daily twice at 10.00AM and 5.00 PM until further orders. Since the police stations are far away from the residence of these petitioners, the petitioners are facing difficulty in signing before the respondent police stations twice a day and hence seeks for modification of the condition.

3. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) appearing for the respondent. 2/4

4. The condition was imposed by the learned Principal Sessions Judge, Kanyakumari District at Nagercoil, is modified and the petitioners shall appear and sign before the respondent police station daily at 10.00 AM and 5.00 PM until further orders.
