: Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to pay pension and retirement benefits of the petitioner including gratuity, leave salary, pension arrears, commutation of pension and all other service benefits to the petitioner with interest at the rate of 18% per annum from the date of the retirement of the petitioner.

ORDER

This Writ Petition has been filed for issuing a direction to the respondents to pay pension and retirement benefits of the petitioner including gratuity, leave salary, pension arrears, commutation of pension and all other service benefits to the petitioner with interest at the rate of 18% per annum from the date of the retirement of the petitioner.

The learned counsel appearing for the petitioner submitted that the petitioner was an employee of the respondent / Transport Corporation and the similar nature of Writ Petitions have been disposed of by the Division Bench Judgment of this Court made in W.A(MD).Nos.385 to 457 of 2015, dated 12.06.2015, whereby, the respondent / Transport Corporation was directed to settle the https://hcservices.ecourts.gov.in/hcservices/ 1/2

WP(MD).No.24929 of 2018 terminal and pension benefits in 12 equal monthly installments along with 6% interest per annum.

3. The learned Standing Counsel appearing for the respondents is not in a position to dispute that this case is different from batch.

4. In view of the above said Judgment passed in W.A(MD). Nos.385 to 457 of 2015, dated 12.06.2015, there will be a similar order in this Writ Petition. Hence, the respondents herein are directed to settle the terminal and pension benefits of the petitioner in 12 equal monthly installments commencing from October 2020 with 6% interest per annum.

5. Accordingly, this Writ Petition is allowed. No costs.
