PRAYER :- For Bail in Crime No.512 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners/A1 and A3 herein, who were arrested on 15.11.2021 for the alleged offence under Sections 294(b), 341, 324, 307 and 506(ii) of IPC, in Crime No.512 of 2021on the file of the respondent police, seek bail.

2.The case of the prosecution is that during pre-marriage function, because of a simple dispute the accused persons assaulted the injured person. Hence the complaint.

3.The learned counsel for the petitioner submitted that the petitioners are innocent persons and they were falsely implicated in this case and they have not committed any offence as alleged by the prosecution.

4.The learned Additional Public Prosecutor submitted that there was a communal problem. It is a case in counter case. Hence, peace committee meeting was conducted and the matter. The defacto complainant was admitted in the hospital on 14.11.2021 and advised to take further treatment in Government Hospital, Madurai and discharged from the hospital. But, the defacto complainant not taking any treatment further.

5.The official from the respondent police are present. But he is unable to report about the outcome of the peace committee meeting. The learned counsel for the petitioner submitted that before the peace committee meeting, both parties agreed to resolve the dispute and copy of the peace committee meeting agreement has also been enclosed along with the typed set of papers. The copy of counter FIR in Crime No.513 of 2021 has also been produced before this Court.

6.Considering the fact that the matter has been settled between the parties in the peace committee meeting, this Court is inclined to grant bail to the petitioners with certain conditions. 7.Accordingly, the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Sivakasi, and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders. sd/- 16/12/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
