O R D E R
[Order of the Court was made by S.M.SUBRAMANIAM, J.] This writ of mandamus has been instituted seeking a direction to the respondents 1 to 5 to consider the petitioner's representation dated 15.12.2023 and to direct them to initiate disciplinary proceedings and suspend the eighth respondent till the disposal of the case registered against him in Crime No.9 of 2023 on the file of seventh respondent.
2. Learned counsel for the petitioner states that an FIR has been registered by the respondent - Vigilance and Anti Corruption Department against the eighth respondent in Crime No.9 of 2023 for the allegation of disproportionate of assets accumulated by him. He further states that the eighth respondent has not been suspended.
3. Learned Additional Government Pleader appearing for the respondents 1 to 5, on instructions, submitted that departmental disciplinary proceedings are already initiated and all appropriate actions will be taken in accordance with the Rules.
4. The petitioner herein being a third party cannot seek any relief in respect of the departmental disciplinary proceedings, which is to be initiated by the competent authority in accordance with law. Since it is an employer-employee relationship, which is governed under the Service Rules, the authorities have to look into the matter and take appropriate decision. However, the relief, as such sought for in the present petition, cannot be granted.
