Prayer in CRL MP(MD). 10580/ 2024 :

To extend the time which has been granted to the petitioner by an order of this Honble Court dated 07.08.2024 made in Crl.OP(MD No. 12838/2024 while releasing him on Anticipatory bail in connection with Crime No. 301/2024 on the file of the Inspector of Police, Thiruvattar Police Station, Thiruvattar, Kanyakumari District forthwith.

Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.B.SARGUNAM, Advocate for the petitioner in both the petitions and of Mr.A.ALBERT JAMES, Government Advocate(Crl.side) on behalf of the Respondent in both the petitions, the Court made the following order:- These petitions have been filed to modify the condition in paragraph No.7 of the order passed by this Court, in Crl.OP(MD)No.12838 of 2024, dated 07.08.2024, and extend the time limit.

2. The learned counsel for the petitioners would submit that by the order dated 07.08.2024, this Court has released the petitioners on anticipatory bail with certain conditions. One of the condition is that the petitioners should deposit a sum of Rs.9,00,000/- to the credit of Crime Number. Due to financial crisis, the petitioners could not comply with the above said condition. Hence, he seeks modification in the above said condition.

3. Considering the submissions made by the learned counsel for the petitioners, the original condition imposed on the petitioners to deposit a sum of Rs.9,00,000/- to the credit of the Crime Number is modified as follows:- 2/4

i) The petitioners shall deposit a sum of Rs.4,00,000/- to the credit of the Crime No.301 of 2024 at the time of execution of securities. Thereafter, within a period of two months, shall also deposit the balance amount of Rs.5,00,000/-. ii) Time is extended by one week from the date of receipt of a copy of this order for furnishing sureties.

iii) Since this modification is being granted as per the request of the learned counsel for the petitioners, it is made clear that no further modification or extension of time will be entertained in this regard.

4. With the above directions, these Criminal Original Miscellaneous Petitions are allowed.
