PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent herein to conclude the enquiry proceedings made in Na.Ka.No.22633/2012/Aa8, dated on 07.02.2013 on his file, within a stipulated period as may be fixed by this Court. The petitioner has made an application for grant of patta for his property in S.No.43-22, Sengipatti Village, Thanjavur Taluk, Thanjavur District and has filed this writ petition for a Mandamus directing the second respondent to conclude the enquiry proceedings within a stipulated time.
2.The learned counsel appearing for the petitioner submits that seeking patta, the petitioner has made a request on 16.11.2012, for which, notice for enquiry was issued only on 07.02.2013 and therefore, a suitable direction may be issued to the official respondents to conclude the proceedings at the earliest. 2/5
3.The learned Additional Government Pleader appearing for the respondents submits that the Tahsildar concerned has completed the enquiry and submitted a report to the Revenue Divisional Officer, Thanjavur and the Revenue Divisional Officer has to pass orders on the petitioner's application. 4.In view of the submissions made by the learned Additional Government Pleader and considering the limited prayer sought for by the petitioner, this Court suo motu impleads the Revenue Divisional Officer, Thanjavur as a party to this writ petition and this writ petition is disposed of with a direction to the Revenue Divisional Officer, Thanjavur to conclude the proceedings as expeditiously as possible preferably within a period of twelve weeks from the date of receipt of a copy of this order.
