PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 1 and 2 to construct a dividing dam at Mampatti Village, Illuppur Taluk, Pudukottai District and ensure equitable distribution water between the supply channel Puliyankulam Tank and Perambur Periyakulam Tank as per the order of the second respondent dated 17.09.1976 and by considering the petitioner's representation dated 23.05.2018 within the time stipulated by this Court. ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The writ of Mandamus has been instituted to direct the respondents to consider the representation of the petitioner, dated 23.05.2018. 2.Issuance of such a direction in the present case would do no service to the cause of justice. The petitioner has to establish a right for entertaining the Writ Petition. The direction sought for in the present Writ Petition 2/5

is to construct a dividing dam at Mampatti Village, Illuppur Taluk, Pudukkottai District. It is a policy decision to be taken at the Government level, with the opinion of the experts.

3.In the event of the Courts issuing such a direction, there is a likelihood of causing prejudice to the beneficiaries including agriculturists. Thus, the petitioner has to approach the appropriate authority for redressal of grievance, if any exists.

4.With the above observations, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
