ORDER

The Criminal Original Petition has been filed, invoking Section 528 B.N.S.S., seeking orders to direct the second respondent to complete the investigation and file a final report in Crime No.245 of 2010 dated 25.04.2010, within a stipulated time frame fixed by this Court.

2. It is seen from the records that on the basis of the complaint given by the petitioner, FIR came to be registered in Crime No.245 of 2010 on 25.04.2010 for the offence under Section 420 IPC.

3. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondents would submit that charge sheet was made ready as earlier as on 12.09.2019 but they have not filed the same before the jurisdictional Court and seeks one week time to file the same.

4. This Court is at loss to understand, after making the charge sheet ready on 12.09.2019 why the charge sheet was not filed before the jurisdictional Court for the past more than 4 years. 2/4

5. Considering the above, the second respondent is directed to file the charge sheet before the jurisdictional Court within a period of one week from the date of receipt of a copy of this order and the first respondent is directed to conduct enquiry with regard to the above lapses and take necessary action against the erring officials.

6. With the above direction, this Criminal Original Petition stands disposed of.
