O R D E R

This Writ Petition has been filed to direct the second respondent herein, to release the petitioner's two wheeler i.e.Honda shine bearing registration No.TN 59 BH 0384 as well as the petitioner's passbook and cheque book in connection with the Account No.3283 1684 589 hold by the petitioner at State Bank of India, Aashampakkam Branch, Chennai.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.

3. The learned Additional Public Prosecutor would submit that the abandoned vehicles, viz., 1. TN 57 J 4327 Hero Splendor 2. TN 59 AD 9497 Hero Splendor, 3. TN 59 BH 0384 Honda Shine 4. TN 59 E 1555 Suzuki, have been seized by the second respondent and registered a https://hcservices.ecourts.gov.in/hcservices/ 1/2

WP(MD) No.22769 of 2019 case in Crime No. 458 of 2018 for the offence under Section 102 Cr.P.C. and thereafter, they are also about to hand over the vehicle before the concerned Thasildar. He would further submit that they have not seized any cheque book or other things from the custody of the petitioner.

4. Considering the above facts and circumstances, the second respondent is directed to hand over the vehicles (viz., 1. TN 57 J 4327 Hero Splendor 2. TN 59 AD 9497 Hero Splendor, 3. TN 59 BH 0384 Honda Shine 4. TN 59 E 1555 Suzuki), before the concerned Revenue Authorities within a period of two weeks from the date of receipt of a copy of this order. The petitioner and other respective owners of the vehicles are directed to produce their relevant documents to prove their ownership before the concerned Revenue Authorities and thereafter, the concerned Revenue Authorities are directed to consider the same and pass orders on merits and in accordance with law.

5. With the above directions, this Writ Petition is disposed of. No costs.
