Writ Petition is filed under Article 226 of the Constitution of India, praying this Court Directing the respondents to complete the construction work of underground drainage system and roads in Karaikudi Town within a stipulated time as fixed by this Honourable Court by considering the petitioners representation dated 12/08/2019.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.G.D.MANIKANDAN, Party in person and of MR.R.SATHISH, Advocate on behalf of the Respondents 2 and 3 and of MR.D.VENKATESH, Advocate for the 1st Respondent, the court made the following order:- (Order of the Court was made by S.S.SUNDAR, J.) This application is filed to re-open Cont.P(MD)No.445 of 2021 and punish the respondents/contemnors for wilful disobedience of the orders of this Court, dated 22.10.2019 in W.P(MD)No.18932 of 2019.
2. It is to be noted that the petitioner has filed Cont.P(MD) No.445 of 2021 making similar allegation. The contempt petition was closed based on the submissions of the learned counsel appearing for the respondents that due to Covid-19 pandemic, the project is delayed and that would be completed by the end of June 2021.
3. Today, the learned counsel appearing for the respondents states that out of 144 Kilometres, the entire work is completed in respect of more than 142 Kilometres of length, even by 28.10.2021. The balance is only few metres and the same is likely to be completed within a reasonable time.
4. In view of the submissions and the progress made by the respondents, this Court finds no merits in this application as we do not see any wilful disobedience of the order passed by this Court. Hence, this Sub-Application is closed.
