O R D E R
The Writ Petition is filed seeking a direction to the second respondent to conduct enquiry based on the proceedings of the first respondent in Na.Ka.No.2840071/2025/U(3), dated 02.06.2025 and cancel the patta No.1663 and Patta No.151 issued in favour of respondents 4 to 6.
2.Mr.M.Gangatharan, learned Government Advocate takes notice for the respondents 1 to 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the Petitioner, the Petitioner's mother purchased the subject property in the year 1972. After the death of Petitioner's mother, the Petitioner and his siblings have been in possession and enjoyment of the subject property and the patta 2/6
continued to be in the name of Petitioner's mother. The private respondents 4 to 6 got patta transfer order in their favour by producing invalid documents. Therefore the Petitioner sent a legal notice to the first respondent through his Advocate on 9.5.2025 seeking cancellation of patta issued in the name of private respondents. The said notice was forwarded to the second respondent in the above mentioned proceedings of the first respondent with a direction to the second respondent to consider the same in accordance with law. However, the second respondent has not taken any further action. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra.
4.The Petitioner virtually seeks a direction to the second respondent to consider the legal notice issued by his Advocate and to take further action in accordance with law. This Court is not inclined to entertain the prayer based on the legal notice issued by the Petitioner's Advocate.
5.In view of the same, without expressing any opinion on the merits of the matter, the Petitioner is directed to submit a fresh representation before the second respondent within a period of two weeks from the date of receipt of a copy of this order. If any 3/6
such representation is filed by the Petitioner within the time stipulated by this Court as aforesaid, the second respondent shall consider the same and pass final orders on its own merits after issuing notice to the Petitioner, private respondents 4 to 6 and other interested parties, if any, within a period of 12 weeks from the date of a copy of this order.
6.With the above directions, the Writ Petition stands disposed of. No costs.
