Mr.R.Suresh Kumar Government Advocate (crl.side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.206/2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/ Accused apprehends arrest at the hands of the respondent police for the offences under Sections 379 of IPC in Crime No.206 of 2023, on the file of the respondent police, seeks anticipatory bail. 1/3

2. The case of the prosecution on 23.07.2023, when the respondent police were conducting check up, on suspicion, they stopped a tractor and found 1 1⁄4 unit of vandal sand without valid licence. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent, he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution.

4. Learned Additional Public Prosecutor would submit that the earlier application for anticipatory bail was dismissed o the ground that the petitioner is having two previous cases.

5. Learned counsel for the petitioner submitted that the previous cases have been admitted by the petitioner in the Lok Adalat.

6. It is seen that the petitioner has admitted the offence earlier and later committing the same offence. Hence he is not entitled for any relief before this Court. I find no reason to entertain this petitioner. There is no change of circumstances.
