ORDER

The appellant has filed this second appeal to set aside the Judgment and Decree dated 31.01.2018 in A.S.No.53 of 2011, on the file of Sub Court, Kulithalai confirming the Judgment and Decree dated 27.07.2011 made in O.S.No.266 of 2005, on the file of District Munsif Court, Kulithalai.

2. When the matter was taken up for hearing, learned counsel for the appellant submits that he is unable to get instructions from the client as well as from the instruction counsel. He further submits that he has also sent a registered letter to the respective parties, however, he is unable to get any reply from them. Therefore, he has reported 'no instructions'.

3. Recording the same, the second appeal is dismissed for non prosecution. No costs. Consequently, connected miscellaneous petition is closed.
