Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to withdraw the case in S.C.No.202 of 2024, on the file of the learned Sessions Judge (Mahila Court), Madurai and transfer the same to the Learned Principal District Court, Dindiugl or any other competent Court.

O R D E R

The petitioners/ accused in S.C.No.202 of 2024 have filed this petition seeking transfer of the above case from the file of the Sessions Court (Mahila Court), Madurai to the Principal District Court, Dindigul.

2.The case of the prosecution is that the defacto complainant and the petitioners /accused are neighbours. There was a dispute between them due to trivial issue, due to which, the petitioners said to have assaulted the defacto complainant, her husband and also her brother with Aruval. On the complaint of the defacto complainant, a case in Crime No.134 of 2023 has been registered as against the petitioners for the offence under Sections 294(b), 342, 324, 307, 506(ii) IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act. Subsequently, alteration report has also been filed for the offence under Sections 294(b), 342, 324, 307, 506(ii), 326 r/w 34 of IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act and final report was also filed before the learned Judicial Magistrate in PRC No.18 of 2024. Thereafter, the case was committed to the Principal District Court, Madurai and it was transferred to the Sessions Court (Mahila Court), 2/5

Madurai and now pending in SC No.202 of 2024. 3.The learned counsel for the petitioners seeks transfer of the case from the file of the Sessions Court (Mahila Court), Madurai to the Principal District Court, Dindigul on the following grounds: i. The husband of the defacto complainant is a practising Advocate in Madurai.

ii. The petitioner is facing threat at the hands of the defacto complainant.

4. This Court is not inclined to transfer the case in S.C.No. 202 of 2024 from the file of the Sessions Court (Mahila Court), Madurai on the above invalid grounds raised by these petitioners. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous petitions are closed.
