PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records of the impugned resolution note in Meeting No.4 dated 30.08.2023 passed by the fifth respondent and quash the same as 1/4

illegal and arbitrary and consequently direct the first respondent to change the enquiry officer as 5th respondent to any other competent authority to conduct the genuine enquiry meeting with granting the opportunity to the petitioner.

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself. 2.The order impugned in this writ petition is only a resolution passed by the Panchayat with regard to the No Confidence Motion under Section 205 of the Panchayat Act.

3. This Court is not inclined to interfere with the matter at this stage. It is for the first respondent District Collector / Inspector of Panchayat to take a decision based on the resolution as well as on the reply submitted by the petitioner. Therefore, this writ petition is dismissed with liberty to the petitioner to raise all these grounds by way 2/4

of reply before the District Collector. No costs. Consequently, connected miscellaneous petition is closed.
