ORDER
The petitioner has filed this sub application to reopen the contempt petition in Cont.P.(MD)No.217 of 2024 to punish the respondent for non compliance and to recall the order in Cont.P. (MD)No.217 of 2024 dated 26.04.2024.
2.The petitioner has approached this Court by way of a writ petition in WP.(MD)No.20832 of 2023 that his complaint dated 02.08.2023 lodged before the respondent Police has not been considered. This Court by its order dated 05.10.2023 has disposed of the said writ petition as under:- 4.Considering the submissions made by both sides and on perusal of the records, it appears that the petitioner though filed a complaint before the respondent Police is not interested to get it resolved. In view of the above, the Criminal Original Petition is disposed of, directing the petitioner to appear before the respondent Police on the basis of a summon alleged to have been issued and produce all materials in respect of the allegations against his Branch Manager including the CCTV cameras, on which, 2/6
the respondent Police are directed to dispose of the same as quickly as possible not later than two weeks from the date of receipt of a copy of this order.
3.The petitioner has filed a contempt petition in Cont.P. (MD)No.217 of 2024 that the above order of this Court has not been complied with. In the contempt petition a representation has been made that final report has been filed before the concerned Court and it has been taken on file in C.C.No.9 of 2024. The petitioner, after verifying with the concerned Court as to whether any final report filed in C.C.No.9 of 2024, has filed this sub application to reopen the contempt petition.
4.The learned Government Advocate (Crl.side), on instructions, submits that the complaint of this petitioner has been treated as petition enquiry in CSR.No.765 of 2023 and it was closed on 05.12.2023. According to him, closure report has also been served on the petitioner. However, a representation has been made based on the instructions provided in the contempt 3/6
petition it has been reflected in Cont.P.(MD)No.217 of 2024 and it was closed. Taking advantage of the same, the petitioner is now insisting for filing of final report based on his complaint. 5.Since it is reported that the complaint of this petitioner has been treated as petition enquiry in CSR.No.765 of 2023 and the same has also been closed on 05.12.2023 and it has also been communicated to the petitioner, this sub application is dismissed. 30.01.2026 NCC : Yes/No Index : Yes/No Internet:Yes gns 4/6
