For Respondent : Mr.P.KOTTAI CHAMY, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.16 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioners, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 406, 420, 498(A), 506(i) of IPC and Section 4 of Dowry Prohibition Act 1961, in Crime No.16 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that on 20.01.2019, the marriage solemnized between the de-facto complainant and the first accused who is the son of the first and second petitioners. Out of the said wedlock, they were blessed with one female child. In the meantime, the first accused had demanded additional dowry and to get the Government job to the third petitioner. Hence, the complaint.

3. The learned counsel appearing for the petitioners submits that the petitioners are the innocent persons and they are falsely implicated in this case.

4. The learned Government Advocate appearing for the respondent Police submits that the jewels are yet to be recovered from the first accused.

5. This is the second anticipatory bail petition filed by the petitioners and the earlier petition filed by the petitioners along with other accused in Crl.O.P(MD) No.15530 of 2021 was dismissed on 19.11.2021, after elaborately considering the points raised by the petitioners. However, the application filed by the petitioners is without referring the change of circumstances to consider the case. Since there is no change of circumstances and also considering the antecedents of the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
