For Respondent : M/s.T.Senthilkumar Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.12 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police for the offence punishable under Sections 8(C), r/w. 20(b)(ii)B and 27(a) of NDPS Act, in Cr.No.12 of 2021 on the file of the respondent Police, seeks anticipatory bail.
2. This is the second anticipatory bail petition. The earlier anticipatory bail petition was dismissed by this Court, by order dated 21.10.2021 on the ground that the petitioner has not appeared before the respondent Police for enquiry.
3. When this petition came up for hearing on 21.12.2021, the learned counsel for the petitioner submitted that the petitioner is now ready to co-operate with the respondent Police for enquiry. https://hcservices.ecourts.gov.in/hcservices/
Considering the said submission, this Court, by order dated 21.12.2021, granted interim anticipatory bail for a period of two weeks, with a direction to the petitioner to appear before the respondent for enquiry.
4. Today, the learned Additional Public Prosecutor filed a report of the respondent Police that the petitioner, who availed interim anticipatory bail from this Court, has not co-operated for investigation.
5. Considering the conduct of the petitioner and also considering the nature of offence, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, the Criminal Original Petition is dismissed. The respondent Police is directed to secure the petitioner and proceed with the investigation.
