Respondent/Complainant PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to modify the condition in Cr.M.P.No.1709 of 2021 dated 01.12.2021 imposed by the learned Fast Track Mahila Judge, Dindigul, to the petitioner in connection with Crime No.1150 of 2021 on the file of the respondent police.

ORDER

This petition has been filed seeking modification of the condition imposed on the petitioner, in Cr.M.P.No.1709 of 2021, dated 01.12.2021, by the learned Sessions Judge, Fast Track Mahila Court, Dindigul, in connection with Crime No.1150 of 2021 on the file of the respondent police.

2.By the order dated 01.12.2021, the learned Sessions Judge, Fast Track Mahila Court, Dindigul, in Cr.M.P.No.1709 of 2021, which was filed seeking anticipatory bail, imposed the condition upon the petitioners that the petitioners shall deposit a sum of Rs.20,000/- (Rupees Twenty Thousand only) each in the Court instead of two physical sureties. Apart from the cash security, execution of own bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) has also been ordered.

3.The grievance of the petitioners are that they are daily wager and they are not in a position to arrange the sum of Rs.20,000/- (Rupees Twenty Thousand only) and make cash security as ordered by the trial Court. Crl.O.P.(MD)No.20172 of 2021 The learned counsel for the petitioners submitted that the first accused married the victim girl.

4.Considering the facts and circumstances of the case, the fact that the first accused married the victim girl and the request made by the petitioners, this Court is inclined to modify the condition. 5.Accordingly, this Criminal Original Petition is allowed and the condition imposed on the petitioners by the trial Court is modified to the effect that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum instead of the cash sureties.
