ORDER

This writ petition is filed for a mandamus directing the first respondent to reclassify the land in S.Nos.142/2 & 142/3 of Nadumudhalaipatti Hamlet, Mudhalaipatti Village, Usilampatti Taluk, Madurai District, as Natham and for grant of patta in favour of the petitioner, by considering the recommendations of the respondents 2 & 3.

2.The petitioner has relied on the recommendations of the Revenue Divisional Officer and the Tahsildar dated 12.08.2010 & 21.05.2010 respectively, for grant of free house patta.

3.Learned Additional Government Pleader, on written instructions received from the third respondent / Tahsildar, submitted that the subject 2/4

properties are classified as Vandipathai, Well and Manthai. Based on the recommendations of the then Tahsildar, enquiry was conducted and it was found that the petitioner is not residing in that place. 4.He further submitted that the petitioner is now residing with his wife, Pandiammal, at Kannanur Village. The said Pandiammal was also granted with an assignment at Kannanur Village by the Tahsildar, Usilampatti, in Na.Ka.No.1250/2007/A2 dated 03.02.2007 in S.No.165/15-0.25.0. He further submitted that the petitioner is having lands and also a house, he is not entitled for any free house site patta.

5.Recording the aforesaid submission made by the learned Additional Government Pleader, this writ petition stands closed. No costs. Index :
