Prayer :- This Criminal Miscellaneous Petition is filed under Section 430(1) of BNSS, 2023 to suspend the sentence imposed on the petitioners/Accused No.1 to 5 in Spl.S.C.No. 105/2018 dated 14.07.2025 on the file of the learned Special Court for Trial of Cases under SC/ST (POA) Act, Theni and enlarge them on bail till the disposal of the appeal.

The petitioners/A1 to 5 in Spl.SC.No.105 of 2018, on the file of the Special Court for trial of Cases under SC/ST (POA) Act, Theni were found guilty by the trial Court and they were convicted and sentenced as under:- Sl.No Sections Punishment Fine amount Default A1 to A5 294(b) IPC - Rs.1000/- each One month simple imprisonment 2/7

Along with the appeal, the petitioners have also moved this application to suspend the sentence imposed on them by the trial Court.
2.Heard the learned counsel appearing for the petitioners. 3.The petitioners have raised certain arguable points, which can be considered only during the final hearing of the appeal. However the appeal could not be taken up immediately, for want of time. In 3/7
view of the above and considering the nature of offence, this Court is inclined to suspend the sentence imposed on the petitioners with certain conditions.
4. Accordingly, the substantive sentence of imprisonment alone is suspended pending disposal of the criminal appeal and the petitioners are ordered to be enlarged on bail on the following conditions:- i. The petitioners shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties each for a like sum to the satisfaction of the Special Court for trial of cases under SC/ST (POA) Act, Theni.
ii. The petitioners shall report before the respondent police on the first working day of every month until further orders. iii.The petitioners shall file an affidavit of undertaking before the respondent police that they will not indulge in any offence 4/7
in future.
iv. In the event, if the petitioners have violated any of the above conditions, it is open to the respondent police to file an application to cancel the bail granted to them. 04.03.2026 Index : Yes/No Internet : Yes/No vrn 5/7
