ORDER

This petition has been filed to call for the records in connection with C.C.No.98 of 2015 on the file of the learned Judicial Magistrate, Valliyoor, Tirunelveli District in connection with Crime No.161 of 2013 on the file of the Inspector of Police, Thirukurunkudi Police Station, Thirukurunkudi, Tirunelveli District and quash the same as devoid of merits and illegal.

2. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent police submitted that in this case only 4 witness has to be examined, out of 11 witnesses and the same could not be completed within a short period. He further submitted that now, the case is posted for examination of L.W.5, L.W.9, L.W.10 and L.W.11

3. Since the trial has already been progressed, it cannot be appropriate to quash the C.C. The petitioner can workout his remedy depending upon the outcome of the trial process. 2/4

In the result, this Criminal Original Petition is dismissed. Consequently, the connected miscellaneous petitions are closed. 29.09.2023 NCC :
