PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 2 and 3 to consider the petitioner's representation dated 08.05.2023 and to take action against the respondents 4 and 5.

O R D E R

This Writ Petition is filed seeking for a Mandamus to the respondents Police to consider the representation of the petitioner dated 08.05.2023 and to take action against the respondents 4 and 5.

2. It is submitted by the learned counsel appearing for the petitioner that the respondents 4 and 5 have floated a Financial Company and collected huge amount as investment from the innocent persons and failed to return the same and the petitioner is also one of the investors and Manager of one of the branches and he has filed a complaint against the respondents 4 and 5 and the respondents 4 and 5 have been 2/6

threatening the petitioner to withdraw the complaint, on which, the petitioner is stated to have sent a representation on 08.05.2023 and the said representation has not been attended to by the Police and thereby, he sought for suitable directions.

3. The learned Government Advocate (Criminal side) appearing for the respondents Police submits that the respondent No.5 has collected huge amount of Rs.4 Crores from various investors and there are about 400 complaints received so far, in which, there are 15 complaints against the petitioner alleging that he has collected about more than Rs.1 Crore and jewels and misappropriated them by not depositing the same in the Company. It is further submitted that the Police would make an enquiry in respect of the representation given by the petitioner and in case if it is found that the respondent No.5 has committed any offence, certainly the Police would take action, basing on the representation of the petitioner.

4. In view of the submissions made by both sides, the respondents Police are directed to enquire in respect of the representation given by the petitioner dated 08.05.2023 and dispose of the same as quickly as 3/6

possible not later than six weeks from the date of receipt of a copy of this order.

5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
