ORDER

The petitioner has approached this Court with a grievance that the respondent Police has not register the case, even after the direction of the learned Magistrate in Crl.M.P.No.46 of 2024 dated 02.05.2024.

2.The learned Government Advocate(Crl.side) appearing for the respondents 1 & 2 submits that based on the directions of the learned Magistrate, a case in Cr.No.226 of 2025 has been registered, on 24.08.2025. A copy of FIR has also been produced before this Court. 2/5

3.It appears that the petitioner has lodged a complaint before the respondent Police and also filed a petition before the learned District Munsif cum Judicial Magistrate Court, Krishnarayapuram under Section 156(3) Cr.P.C., seeking a direction to the respondent Police to register a case. The learned Magistrate, by an order dated 02.05.2024, directed the respondent Police to register a case. However, the respondent Police registered the case only on 24.08.2025.

4.Considering the manner in which the complaint, which has been forwarded by the learned Magistrate, by an order dated 02.05.2025, has been registered only on 24.08.2025, that too, after filing of this writ petition, this Court directs the Superintendent of Police, Karur District to withdraw the case in Cr.No.226 of 2025 from the file of the first respondent Police and entrust the same to some other sincere Officer. Superintendent of Police to verify with regard to the manner in which the direction issued by the learned Magistrate has been considered by the respondent Police and to take appropriate action. Accordingly, this writ petition is closed. No costs.
