For Respondent : Mr.B.NAMBISELVAN, Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No.238/2023 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/Accused, was arrested and remanded to judicial custody on 01.08.2023, for the alleged offence punishable under Sections 392 and 397 of IPC, in 1/3

Crime No. 238 of 2023, on the file of the respondent police, seeks bail.

2. The case of the prosecution that the defacto complainant owned two Alexandrite stones worth about Rs.1,50,000/-. The defacto complainant approached the accused Nos. 1 and 2 to sell the stone. For that purpose the defacto complainant along with the accused Nos. 1 and 2 went to Coimbatore in a car. At that time another car came in front of the their car and some accused persons, attacked the defacto complainant with aruval and the accused No.1 and 2 and snatched the alexandrite stones from the defacto complainant. The defacto complainant sustained grievous injury in this incident and admitted in the hospital. Hence the complaint.

3. The learned counsel for the petitioners would submit that the petitioners are innocent, they have not committed any offence alleged by the prosecution. They have been wrongly implicated in this case.

4. Learned Additional Public Prosecutor would submit that totally seven accused are there in this case. The petitioners were arrested and other accused persons are yet to be apprehended. The defacto complainant sustained grievous injury all over the body in that incident.

5. Considering the facts and circumstances of this case and considering the seriousness of the offences and the manner in which the offence was committed, these petitioners are not entitled for any discretionary relief from this Court. If the 2/3

petitioners are released on bail, they may abscond or tamper the witnesses in this case.
