ORDER : The Court made the following order :- The petitioner /accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2) and 238(c) and Section 21(4) 1/3

of Mines and Minerals (Development and Regulation) Act in Cr.No.467 of 2024, seeks anticipatory bail.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent Police and perused the materials available on record.

3. Considering the nature of allegations, already the prayer has been considered and rejected in Crl.O.P(MD).No.14284 of 2024. I do not see any change of circumstances after dismissal of the earlier petition on 29.08.2024. The learned counsel for the petitioner submits that the co-accused has been released on bail. The same cannot be a change of circumstances to consider the application for anticipatory bail to the petitioner and hence, I am not inclined to enlarge the petitioner on anticipatory bail.
