The Writ Petition filed under Article 226 of the constitution of India, seeking for the issuance of Writ of Mandamus, to direct the Superintendent of Police, Dindigul District to provide the adequate Police protection to petitioner's Cheran Vidyalaya Matriculation Higher Secondary School located at Cheran Nagar, Bypass, Kalikkampatti-624 303, Chinnalampatti, Ahtoor Taluk, Dindigul District and also to the students and staffs in the light of the petitioner's representation dated 21.07.2025.
COMMON ORDER These petitions are filed by the Principal and Correspondent of Cheran Vidyalaya Matriculation Higher Secondary School, Chinnalapatti, Dindigul District.
2. Crl.OP(MD)No.13968 of 2025 is filed by the Principal seeking transfer of investigation in Crime No.183 of 2025 from the file of the Inspector of Police, Chinnalapatti Police Station to any other officer. 5/11
3. WP.Crl(MD)No.1046 of 2025 is filed by the Correspondent of the School seeking a mandamus forbearing the Tahsildar, Athoor, from interfering with the administration of Cheran Vidyalaya Matriculation Higher Secondary School.
4. WP.Crl(MD)No.1049 of 2025 is filed by the Principal seeking police protection.
5. Since all the petitions are pertaining to the affairs of Cheran Vidyalaya Matriculation Higher Secondary School, Chinnalapatti, Dindigul District, all of them are heard together and are disposed of by this common order.
6. The case of the petitioners is that on 17.07.2025, a group of 85 individuals, in Advocate attire, unlawfully entered into the school premises, damaged the properties, assaulted the staff, used vulgar threatening language, at the instance of one Asokan, a Trustee. For this incident, a complaint has been lodged by the Principal and the same was registered in Crime No.183 of 2025 on the file of the Chinnalapatti Police Station. However, at the instance of the trespassers, another complaint was also registered by the Chinnalapatti Police in Crime No.182 of 2025. Both the complaints were referred to the Tahsilar, Athoor 6/11
and the Tahsildar, without any authority, has passed an order permitting the said Asokan, Trustee, to enter into the school premises.

The petitioners have also made serious allegations as against the Inspector of Police, Chinnalapatti Police Station and has added the Inspector of Police as a party to this proceedings in his individual capacity; filed a copy of the transcription of an alleged conversation between the Inspector of Police and the said Asokan.

Learned Counsel for the petitioners, by placing certain photographs and CCTV footages, submitted that at the instance of one Asokan, a Trustee, 85 persons in the attire of Advocates unlawfully entered the school premises during school hours, ransacked the office building and caused damages. They have also criminally intimidated the staff and students.
9. Mr.G.Prabhu Rajadurai, learned Counsel for the impleading petitioner / a Trustee of the School submitted that it is purely a dispute among the Trustees and the petitioners have created a drama to take over the possession of the School.
10. Considering the rival submissions made, this Court by its earlier order dated 22.08.2025, directed the Superintendent of Police, Dindigul, to file a report. 7/11

The Superintendent of Police has filed a report that pursuant to the orders, he has verified with regard to the allegation and counter allegation and vide proceedings dated 23.08.2025, has nominated the Additional Superintendent of Police (Headquarters), Dindigul, to conduct a detailed enquiry as to the allegations made as against the Inspector of Police. He further submitted that both the cases in Crime Nos.182 & 183 of 2025 were transferred from the file of the Chinnalapatti Police Station to the Deputy Superintendent of Police, Dindigul Rural Sub-Division, Dindigul, with a direction to conduct an impartial investigation and to conclude the investigation in both the cases within a period of one month.

In view of the action taken by the Superintendent of Police, by addressing the grievance of the petitioners, by nominating the Additional Superintendent of Police to conduct an enquiry with regard to the allegations made as against the Inspector of Police and also transferring the investigation in Crime Nos.182 & 183 of 2025 to the Deputy Superintendent of Police, Dindigul Rural Sub-Division, Crl.OP(MD)No.13968 of 2025 and WP.Crl(MD)No.1049 of 2025 are disposed of with a direction to the Deputy Superintendent of Police, Dindigul Rural Sub-Division and the Additional Superintendent of Police [Headquarters] to conduct a fair and impartial investigation and to take appropriate action. 8/11
13. Since criminal investigation is pending, the Tahsildar, Athoor, is not having any role to deal in the administration of the School and the parties shall work out their remedy before the appropriate forum, if so advised. With this clarification, WP.Crl(MD)No.1046 of 2025 stands disposed of.
