For Respondent : Mr.S.Prakash, Government Advocate (Crl.Side) PETITION FOR MODIFICATION Under Sec.528 of BNSS PRAYER :- To set aside or modify the condition imposed by the learned Principal Sessions Judge, Tirunelveli, insofar as it requires the petitioners/accused to appear before the Judicial Magistrate Court, Radhapuram, every Monday at 10.30a.m., until further orders, commencing from 18.08.2025 passed in Crl.MP.No.3596 of 2025 dated 11.08.2025.

ORDER : The Court Made the following order :- This petition has been filed to set aside or modify the condition imposed in Crl.MP.No.3596 of 2025 dated 11.08.2025 on the file of the learned Principal Sessions Judge, Tirunelveli.
2. The learned counsel for the petitioners would submit that these petitioners were arrested and remanded to judicial custody on 04.09.2024. These petitioners had filed a bail application before the learned Principal Sessions Judge, Tirunelveli and the Trial Court had granted bail to the petitioner by way of order dated 10.12.2024 with certain conditions. The said condition is as follows:- '' (iii) The petitioners shall report and sign before the respondent police daily at 10.00a.m. Until further orders and further respondent police is directed to submit the report, deviations if any committed by the petitioners in observing the above condition. On further condition that they shall make available themselves for interrogation as and when required by the investigation officer. ''
3. He further submits that these petitioners complying the said condition regularly. These petitioners filed a modification petition before the trial Court in Crl.MP.No.3138/2025. The trial Court by way 2/6
of order dated 11.07.2025 in Crl.MP.No.3138/2025 had modified the earlier condition and further the petitioners/accused are directed to appear and sign before the Palayamkottai Police Station daily at 10.00a.m. Until further orders commencing from 13.07.2025. As per the said order, these petitioners complying the said condition and regularly appear and sign before the Palayamkottai Police station. These petitioners filed relaxation petition before the trial Court in Crl.MP.No. 3596/2025. The trial Court by way of order dated 11.08.2025 in Crl.MP.No.3596/2025 modified the earlier condition and further the petitioners/accused are directed to appear before the Judicial Magistrate Court, Radhapuram on every Monday at 10.30a.m. until further orders commencing from 18.08.2025.
4. He further submits that these petitioners complying the conditions regularly. Insofar as Crime No.386 of 2024 is concerned, investigation was completed and the charge sheet has been filed and the same was taken on file in PRC.No.6 of 2025 on the file of Judicial Magistrate, Radhapuram. Once again, the trial Court directed the petitioners/accused to appear before the Judicial Magistrate Court, 3/6
Radhapuram on every Monday at 10.30a.m. until further orders commencing from 18.08.2025 is unnecessary and burdensome to the petitioners. Hence, the petitioners seek indulgence of this court by modifying the said condition imposed against them. Hence, he prays for modification of the said condition.
5. The learned Government Advocate (Crl.side) appearing for the respondent has not raised any objection to allow this Criminal Original Petition.

Considering the submissions made by the learned Counsel for the Petitioners and being satisfied with the reasons stated above, this Court is inclined to set aside the order passed by the learned Principal Sessions Judge, Tirunelveli in Crl.MP.No.3596/2025 dated 11.08.2025. Accordingly, the order made in Crl.MP.No.3596/2025 dated 11.08.2025 passed by the learned Principal Sessions Judge, Tirunelveli is set aside and these petitioners are hereby directed to appear before the Judicial Magistrate, Radhapuram on hearing dates without fail. 4/6
7. With the above said observations, this Criminal Original Petition is allowed.
